NetChoice Opposes Chairman Pai’s Decision to Move Forward With FCC Rulemaking on Section 230

Today, NetChoice voiced opposition to FCC Chairman Ajit Pai’s decision to exercise authority it does not have, undermining Section 230 in the process. 

 

“Congress never granted the FCC the power to interpret Section 230,” said Carl Szabo, Vice President and General Counsel at NetChoice. “The history and text of the law both confirm that the FCC lacks the authority to regulate the online speech through Section 230.”

 

“This is an unfortunate attempt by some officials to pressure social media platforms into changing their rules during an election cycle,” continued Szabo. “Unfortunately, these political efforts will come back to haunt conservatives as undermining Section 230 would lead to more, not less, content blocking on social media.”
