Texas Lawmakers Should Consider Balanced AI Rules to Protect Texans and Innovation

AUSTIN, Texas—This week, Texas State Rep. Giovanni Capriglione introduced a new governance framework for artificial intelligence (AI).

The bill is a good start, but it contains a few concerning provisions that would stifle AI development and deployment in Texas. AI is a tool, and anyone using any tool already must comply with numerous existing laws against discrimination, bias, and abuse, across applications like healthcare, finance, and education.

Texas lawmakers should consider enforcement tools and clear, targeted regulations to close any loopholes that might allow bad actors to avoid liability if they abused AI technology. This includes clarifying that harmful AI-manipulated images exploiting minors are unambiguously illegal under existing statutes. Another helpful change for Texans would be updating the state’s privacy law to expressly cover identifiable deepfake media shared with intent to harm. These provisions would punish abusers who seek to harm Texans and their families with AI-manipulated media.
