HB 732: Complaint for Injunctive and Declaratory Relief (Civ. No. 21-cv-410)

On February 18, 2021, NetChoice joined a lawsuit against “Maryland’s Digital Advertising Gross Revenues Tax” (HB 732).  Last week the Maryland General Assembly voted to override Governor Hogan’s veto.  But this law faces multiple constitutional hurdles, including a discriminatory approach that is likely to be overturned by the court.

“This law is like a toll booth that collects only from new cars and no one else, so any state following Maryland’s awful example will have to refund all those tolls when a court rules that it’s illegal discrimination,” said Steve DelBianco, President and CEO of NetChoice.

“The Internet Tax Freedom Act was created to prohibit precisely what Maryland is doing here by imposing discriminatory charges only for online forms of advertising,” continued DelBianco.
