NetChoice and CCIA filed an amicus brief supporting Apple’s motion for a stay of the District Court’s injunction.
The brief argues that at least part of the District Court’s injunction violates the First Amendment by compelling speech. Specifically, the brief focuses on the court’s prohibition against setting conditions for link placement and language around it’s in-app purchasing system.
The District Court’s demand that Apple display speech—even speech that would disparage Apple—it would rather not convey violates the First Amendment.
