NetChoice Amicus Brief in Support of Apple’s Petition for Certiorari in Apple v. International Trade Commission

NetChoice joined a brief with the Association for Competitive Technology, Public Interest Patent Law Institute, and TechNet in support of Apple’s petition for certiorari before the United States Supreme Court. Our brief urges the Court to accept Apple’s appeal to stop the blurring of the International Trade Commission’s (ITC) authority. There is a clear line between ordinary patent litigation and the ITC’s exceptional trade remedy. Recent decisions from the Federal Circuit weaken that distinction to the disservice of innovation and despite Congress’s clear intent when enacting Section 337.
