“More Speech, Fewer Mistakes”: Free Expression Takes Center Stage at Meta

Today, Meta CEO Mark Zuckerberg announced a transformative shift in the company’s approach to content moderation: a strategy more focused on the principle of “More Speech, Fewer Mistakes.” The move signals a fresh commitment by the company to reduce content removal, focus on stopping bad actors, enhancing transparency and improving user trust. By integrating advanced AI and innovative frameworks, Meta aims to strike a revised balance between removing egregious content and preserving legitimate free expression on its platforms.

In his video announcement, Zuckerberg emphasized the importance of minimizing “false positives,” or instances where legitimate content is mistakenly flagged or removed. This focus will help give users more transparency in the company’s moderation practices, a new approach to responsibly moderating content while maintaining vibrant, open spaces for communication.

Meta’s new approach includes the rollout of new, advanced AI tools designed to identify harmful content with greater precision. These tools aim to significantly reduce mistakes in moderation while improving the speed and accuracy of enforcement decisions. The company also plans to invest in better appeals processes, ensuring users have clearer and more equitable paths to challenge content takedowns. Regular updates on moderation practices and performance metrics will also be shared with users, allowing them to better understand how the system works and to trust its outcomes. 

Meta’s announcement showcases the kind of innovation that is possible when platforms’ rights to adapt their moderation practices are protected.

This freedom is rooted in the First Amendment and emphasized the Supreme Court’s 2024 NetChoice v. Moody decision. The Court’s NetChoice Doctrine reaffirmed the protected right of platforms to moderate content in ways that reflect their unique communities, values, and business models.

The NetChoice Doctrine guarded platforms’ speech rights from government-dictated content moderation rules. This decision has affirmed platforms like Meta, X, Rumble and Bluesky can experiment with moderation systems that reflect their customers’ needs—not politicians’ desired outcomes for content. Without the constraints of government speech codes, platforms are free to explore new technologies and strategies to better serve their users.

Meta’s announcement is a positive example of what happens when platforms are empowered to freely innovate. The First Amendment protects this capability in online spaces just as it does in offline ones. This has allowed a diverse market of online spaces to emerge, from X to Reddit, Nextdoor, Instagram, Rumble, YouTube, Truth Social and more.
