NetChoice joined the U.S. Chamber of Commerce’s amicus brief in the D.C. Court of Appeals supporting Meta’s petition for a writ of mandamus in In re Meta Platforms. The brief highlights two points. First, the Superior Court’s ruling threatens to eliminate in-house counsel’s ability to provide general advice on risk-minimization to clients. Second, at a minimum, the Superior Court’s decision undermines attorney-client privilege by creating confusion and uncertainty about when exceptions to privilege apply.
