NetChoice filed an amicus brief supporting X and Rumble’s challenge to California’s political speech censorship law, AB 2655, in Babylon Bee v. Bonta.
The brief argues that Section 230 preempts state government attempts to control websites moderation decisions, and highlights the challenges in separating malicious political deepfakes from protected satire, parody, and protected political speech.
The brief also calls attention to the problem of over-censorship tied to notice-and-takedown regimes.
