NetChoice, joined by Chamber of Progress and the Pelican Institute, filed a brief in the Fifth Circuit in support of Bodin in Bodin v. New Orleans. The brief explains why a New Orleans ordinance that requires short term rental services (e.g., Airbnb) to monitor listings and remove them if they violate the city’s requirements violates Section 230. In short, New Orleans is attempting to impose liability for distributing content in a manner Congress has said is impermissible.
