NetChoice Amicus Brief Supporting Meta, Google, and TikTok in Meta, Google, and TikTok v. Bonta

NetChoice filed an amicus brief in the Ninth Circuit supporting Meta, Google, and TikTok’s respective appeals from the denial of a preliminary injunction against California’s SB 976, which prevents certain websites from employing personalization algorithms to disseminate content. NetChoice’s brief provides an industry-wide perspective on the value of personalization beyond just the three companies appealing here. We explain how organization has always been necessary to make a large trove of information useful; from the Dewey Decimal System to the TV guide, information must be presented in a way for the user to derive value from that presentation. In the internet age, personalization algorithms are the next link in that longstanding chain of protected editorial choice.
