NetChoice, joined by Chamber of Progress, filed an amicus brief in support of Meta and Instagram’s appeal from the denial of a motion to dismiss in Commonwealth of Massachusetts v. Meta Platforms, Inc., and Instagram, LLC. The Commonwealth of Massachusetts alleges that various elements of Meta’s services—such as “likes,” “Instagram Live” or “Reels” are harmful.
NetChoice’s brief explains that the Commonwealth’s arguments are foreclosed by Section 230—a federal statute that provides immunity to websites for the publication of third-party speech, including decisions related to the presentation and display of that content.
