NetChoice Amicus Brief Supporting Mosaic’s Motion for Summary Judgment in In re Mosaic LLM Litigation

NetChoice joined the Computer & Communications Industry Association (CCIA) and AI Progress to explain why training models for Generative AI does not violate copyright law. Our brief makes three key points. First, copyright law has always been about protecting progress, not protectionism. That’s why the First Amendment fair use exception to copyright is so crucial. Second, training GenAI models is a transformative use and so qualifies as non-infringement of the copyright. Finally, the plaintiffs’ theories about market dilution are antithetical to the purposes of copyright law.
