SB 199’s social media age-verification provisions are unconstitutional under the First Amendment, undermine privacy, and would deter both adults and minors from accessing protected online speech and vital resources. Recent court rulings have halted similar laws, asserting that mandatory ID-based or third-party age verification and restricted access hours unlawfully burden free expression. SB 199 would require extensive collection and transmission of sensitive personal and transactional data, creating serious privacy, security, and identity-theft risks for Hoosiers.
