Carl Szabo, policy counsel for NetChoice, said a state law is important because federal law blocks providers from releasing contents of online communications, except under narrow circumstances.

This is a problem, he said, because some people want to share some information, such as online-stored photos, with members of their family. And he said estate executors also need access to some online records to resolve financial matters.

“As we begin moving more and more of our financial and electronic transactions online, it becomes a bit more difficult for the next of kin to find out where the money is or find out what services are still active when somebody dies,” he said.
