Congress Must Clear the Runway for American AI Innovation

WASHINGTON—Today, the U.S. House Energy and Commerce Committee will hold a subcommittee hearing on “Artificial Intelligence (AI) Regulation and the Future of US Leadership.”

It is critical that America stays first in the global race for technological innovation. The 118th Congress’ House AI Task Force studied the issue thoroughly and laid out a helpful blueprint that today’s policymakers should follow. This approach would ground American AI policy in permissionless innovation, workforce development and global leadership while ensuring that real, demonstrable harms by criminals abusing these important tools are restricted. 

It is additionally imperative that Congress lead the way on American AI policymaking. A 50-state patchwork of confusing and likely conflicting laws would create a compliance nightmare for small businesses and little tech, making it much harder for them to outrun the big guys. Recent reporting found more than 1,000 state-level AI regulations introduced just in 2025—a thick web of red tape that will trap American innovation and severely limit us from achieving President Donald Trump’s Golden Age vision. 

NetChoice applauds the committee for advancing a 10-year moratorium on state-level AI legislation in the Reconciliation package and looks forward to working with lawmakers to get a federal package that will supercharge America’s AI dominance while respecting our rights and freedoms.
