NetChoice joined an amicus brief with the US Chamber of Commerce, American Tort Reform Association, and American Property Casualty Insurance Association supporting Tesla’s appeal of a jury award for alleged product liability and failure to warn consumers. The brief argues that the award improperly rests on current industry standards rather than industry standards for 2019 when the crash occurred. Permitting jury awards disconnected from the facts will chill innovation and have a detrimental impact on consumer safety in the long term.
