NetChoice Testifies on Cybersecurity Risks of New Hampshire Digital Choice Act

NetChoice opposes New Hampshire HB 1589, the Digital Choice Act. The bill’s interoperability mandates would degrade user privacy and create security backdoors exploitable by malicious actors. Forcing platforms to share “social graphs” exposes user data to unvetted services without consent and creates a perverse incentive for companies to freeze security standards rather than innovate. Additionally, the legislation is legally compromised, violating the New Hampshire Constitution’s privacy protections as well as the U.S. Constitution, specifically First Amendment rights regarding content curation and Takings Clause concerns over proprietary technology.
